| Because of a flaw in the law, legal spouses of American citizens face automatic denial and threat of deportation when their spouses die during lengthy bureaucratic green card processing. There are over two hundred of these cases across the country affecting women, mothers and children.
This horrible, unintended practice is called the Widow Penalty, and efforts have been under way since 2004 to end the widow penalty. See the Obama Administration response which fails to overturn the Widow Penalty, but gives a two year reprieve on the deportations of surviving spouses!
